Terms of Service

< By accessing or using the Thyra websites, applications, and services (the "Services") provided by Endo Mind, Inc. ("Thyra"), you agree to these Terms. If you use the Services for an organization, you represent that you have authority to bind it. If you do not agree, do not use the Services. Our Privacy Policy is incorporated by reference.
The Services
Thyra provides software to support clinical and administrative workflows, which may include documentation support, task management, analytics, telehealth, and integrations. The Services do not provide medical advice and are not for emergency use. Customers remain responsible for clinical decision-making and compliance with applicable law. Features may change, and beta features may not be suitable for production.
Accounts and acceptable use
You are responsible for safeguarding credentials and for activity under your account, and must report suspected unauthorized use to support@thyrahealth.com. You may use the Services only for lawful purposes. You must not build a competing product, reverse engineer (except where permitted by law), disrupt or gain unauthorized access to the Services, upload malware, transmit unlawful content, or make unsupported clinical claims. You must comply with applicable laws including HIPAA and state privacy laws.
SMS/Text messaging terms
Program. Medical practices that use Thyra may send text messages to patients who have opted in. The practice named at the time you opted in is the sender of those messages; Endo Mind, Inc. ("Thyra") transmits them on that practice's behalf as its service provider.
Consent. You are enrolled only if you affirmatively opt in — by checking an unchecked box, completing a form, or giving verbal or written consent recorded by the practice. Consent to receive text messages is not a condition of receiving care, of purchase, or of creating an account. Email and the secure patient portal are always available instead.
Message types. Appointment reminders and confirmations, cancellation and reschedule handling, patient-portal invitations, and account and security notifications. These are transactional messages. The program does not send marketing or promotional messages and does not use purchased or rented lists.
Frequency. Message frequency varies and depends on your appointments and account activity.
Cost. Message and data rates may apply. Thyra and the practice do not charge for the messages themselves; your mobile carrier's standard rates apply.
Opt-out and help. Reply STOP to any message to stop receiving texts from that practice; you will receive one confirmation and then no further messages. Reply START to resume. Reply HELP for help, or use the support contact shown in the message.
Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your carrier and device. Do not rely on text messages for urgent or emergency medical needs — call the practice, or 911 in an emergency.
Privacy. Mobile opt-in information and consent are never sold, rented, or shared with third parties or affiliates for their own marketing purposes, and are not shared with any third party for any purpose other than delivering the messaging service you requested. See our Privacy Policy.

Subscriptions, pilots, and fees
Subscription terms, pricing, and any pilot period are set in an order form or written Customer Agreement, which controls for the customer's use where it conflicts with these Terms. Unless stated otherwise, subscriptions auto-renew and fees are non-refundable. Revenue cycle management and other optional services may be offered under separate terms. See pricing.
Health data, HIPAA, and BAA
If customer content includes PHI, the parties will enter a BAA where required by HIPAA. Customers are responsible for determining whether a BAA is required and for providing patients with required notices and consents. When a BAA applies, it governs our use and disclosure of PHI.
Intellectual property, disclaimers, and liability
Thyra and its licensors own the Services; customers retain rights in their content and grant us a limited license to host and process it to provide the Services. The Services are provided "as is" without warranties to the maximum extent permitted by law. Clinical decision support and documentation tools support, but do not replace, professional judgment | customers and clinicians remain responsible for reviewing outputs. Liability is limited as described in the full Terms (generally excluding indirect damages and capped at amounts paid in the prior 12 months).
Governing law and contact
